TERMS & CONDITIONS OF USE (WEBSITE)

The e-commerce sites www.paulienvandenbrande.com  and www.paulienvandenbrande.be  (the "Website") are sites where PAULIEN VAN DEN BRANDE, with its registered offices at Nieuwe Sint-Annadreef 50, 8200 Brugge (Belgium), and is registered at the Crossroads Bank for Enterprises under number 1032270139 (referred to hereinafter as "PVDB"). PVDB creates, designs and sells luxury ready-to-wear clothing and fashion accessories, as well as fabric designs and artworks, through its Websites (the "Products"). 

Internet users wishing to buy the Products are referred to as the "Customer" in these Terms of Use. PVDB and Customer are hereinafter also individually referred to as a "Party" or together as the "Parties".

The Customers can contact the Customer Service via the contact form available in the 'Contact' section of the Sites or via the e-mail address info@paulienvandenbrande.com,  if they experience any problems with the Sites or their order.

ARTICLE 1 - SCOPE OF APPLICATION

The present Terms of Use govern the rights and obligations of the Parties arising out of the online sales of Products offered on the Sites belonging to PVDB. PVDB provides all its services from Belgium, and the contract between the Parties will be deemed to be performed in Belgium, dispatching to different countries.

The Websites are controlled and operated by PVDB from Belgium and aim to target consumers located in the following countries only: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.

You are responsible for ensuring that you are a resident of a country and region that can receive deliveries of Products. If you do not reside in any of the countries listed above, you will not be able to place an order through the Website.

These Terms of Use apply to all Products sold on the Sites and prevail over any and all other terms and conditions of PVDB or the Customer. They may only be amended in writing.

ARTICLE 2 - CAPACITY IN LAW AND ACCEPTANCE

In order to place an order on the Website, the Customer must have reached the age of majority, enjoy legal capacity and hold a credit card or any other payment instrument accepted on the Website (as indicated at the time of validating the order).

Anyone wishing to buy the Products from PVDB on the Sites must have the legal capacity or otherwise purchase the Products through their lawful representatives.

The Customer accepts these Terms of Use expressly through the ordering process by clicking on a tick or putting a cross against the words "I accept the Terms of Use".

The Customer can print these Terms of Use.

The Customer undertakes to ensure that all the information communicated to PVDB via the Website in the context of his/her order is compliant with these Terms of Use, accurate and up-to-date. Failing this, PVDB reserves the right to cancel the order and the corresponding payment. PVDB will not be responsible for any consequences of inaccurate information provided by the Customer.

It is expressly agreed between PVDB and the Customer that e-mails exchanged between the Parties and any information registered on the Website through PVDB's automatic registration systems shall be held to be authentic and serve as proof.

ARTICLE 3 – PRODUCTS

The Products offered for sale on the Website are handmade items. As such, each Product is unique and may display slight variations in colour, texture, measurements, finishing details and overall appearance. These variations are inherent to the handmade nature of the Products and are not to be considered as defects or non-conformities. By placing an order, the Customer acknowledges and accepts that such variations are part of the authentic character and craftsmanship of handmade Products.

The Products offered for sale on the Sites are those that appear on the Sites at the moment at which the Customer visits them and which are indicated as being sold by PVDB.

Products are offered for sale within the limits of available stocks and only for the purchase of a customary amount for private use. Due to the handmade production process, certain Products may be made to order or available in limited quantities.

Should one or more Products of an order not be available, PVDB will inform the Customer via e-mail or in writing thereof. In such case, the Customer will be promptly reimbursed, in the same means of payment as the Customer used for the original transaction. The promptness of the refund can vary depending on the type of payment chosen by the Customer. In case of a payment by credit card, the refund will appear on the next following monthly statement for that credit card. Should the Customer find the refund is taking an abnormal length of time, she/he shall contact his/her bank.

PVDB will in any case make the refund within 30 days.

All Products offered for sale on the Sites are described in good faith and conscientiously and as accurately as is possible. Whilst taking the utmost care to ensure the maximum degree of accuracy as regards the information on the Products (categories, names, reproduction, pictures, descriptions, properties, characteristics, measurements and composition, etc.) offered for sale on the Website, and regularly updating said information, descriptions and data, PVDB cannot accept liability for any non-substantial errors that may occur, nor for minor variations inherent to the handmade nature of the Products.

Furthermore, although photographs and other reproductions of the Products for sale shall represent them faithfully on the Website, within the limits of the available techniques, they may nevertheless contain non-substantial errors. Due to the handmade nature of the Products, the actual Product received may vary slightly from the photographs displayed on the Website in terms of colour, pattern placement, texture and finishing details. The Product shown in the photograph serves as a representative example of the handmade Product the Customer will receive.

ARTICLE 4 - PRICES

The applicable prices are the ones shown on the Sites at the moment the Customer places the order.

Prices stated during the purchasing process are expressed in euros and include VAT and administrative costs. The Euro (EUR) remains the applicable currency for all orders placed by Customers irrespective of their location.

Product and service prices do not include transport costs which will be charged separately, on top of the purchase price, as specified on the respective Sites. The amount of the extra transport costs, if any, will be automatically displayed, if relevant, on the Website at the time of the validation of the order. Any discount to which the Customer is entitled will be deducted from the price separately. Any bank charges remain the responsibility of the Customer (including in the case of a refund).

PVDB reserves the right to modify the selling prices and transport costs at any time, although the Products purchased and costs will always be invoiced at the prices as stated in the order confirmation e-mail, which are the prices that applied at the time of purchase.

The Customer will receive a confirmation of the order, as well as the corresponding invoice, on an electronic and durable medium.

Products will remain PVDB's property until the respective Customer pays for the Product in full, i.e. until she/he pays the purchase price and all costs in full.

 

In case of manifest error in the indication on the Sites of the price of any Product that the Customer has ordered, PVDB will inform the Customer thereof as soon as possible and give the Customer the possibility to replace an order at the correct price. In any case PVDB will cancel the initial order and refund the Customer for this order.

ARTICLE 5 - PAYMENT

Purchases can only be paid for online, by Visa, MasterCard, American Express, China Union Pay, JCB, Diners, Discover, VISA Electron, Maestro, Bancontact, Apple Pay, Google Pay and PayPal, or any other payment methods indicated on the Website at the moment of the transaction. The Customer's bank account will be debited once the Customer proceeds to the payment, and payment will not take effect until such time as the Customer's bank has given its consent to PVDB. Should the Customer's bank refuse payment, the agreement will not be concluded between the Customer and PVDB. As soon as the Customer's financial institution accepts the payment, the agreement is concluded between the Customer and PVDB.

The Customer undertakes to effect payment via a credit card or payment method of which he/she is the holder, which mentions his/her identity (surname and first name).

The Customer will access a secure server that has been certified by a certification authority. The Customer must provide his/her credit card number and/or his/her bank details by filling in the online payment form. The transaction will then be effected by the Customer in accordance with secure banking standards; the Customer unconditionally agrees in advance that PVDB may complete the secure transaction in question. The authorisation to debit the Customer's account is always given only for the amount of the Products bought.

The Customer warrants that she/he is authorised to make payments by one of the payment methods stated above. It warrants as well that there are sufficient funds in the respective bank account linked to the credit card to cover all the costs arising out of the transaction.

PVDB reserves the right to refuse to fulfil at any time an order with a Customer with whom it is in dispute or who has brought a dispute in the past, or who has not paid for a previous order, wholly or in part.

ARTICLE 6 - ORDERING

The Customer may freely modify the order as long as the Products are in the shopping bag. The price of the Products will be automatically displayed in the shopping bag.

Once the Customer has finished making its selection and wishes to validate the content of its shopping bag and confirm its order, the Customer must identify itself. The Customer must click the "Checkout" button and then identify himself/herself. Existing Customers identify themselves by logging in; new Customers must fill in the necessary fields to create a Customer account.

The Customer must also select a delivery and payment method and will enter its billing and delivery address.

Before proceeding to payment and placing the order, the Customer must accept both the Privacy Policy and Terms of Use by ticking the checkbox provided.

The total amount of the order to be paid, plus the transportation costs, will then be clearly stated.

The Customer will be redirected to a trusted payment provider, which will securely process the payment. Once all the information has been duly fulfilled and validated, the Customer must click on "Place Order and Pay".

Once the payment process is completed, the Customer will see an order confirmation page and will receive, in parallel, a confirmation e-mail sent to the provided e-mail address. All contractual details of the order will be communicated to the Customer in the language the Customer selected and confirmed their order in.

At that point, the order can no longer be modified by the Customer.

The Customer can choose to print the order confirmation page. Nevertheless, the Customer will also receive an order confirmation by e-mail.

The Customer will receive an e-mail from our logistic partner when his/her order is dispatched.

Data registered in PVDB's IT systems, those of its hosting partners or internet payment partners shall constitute evidence of the communications, the content of the orders and the entire transactions which have taken place between the Parties.

ARTICLE 7 - DELIVERY

Products can only be delivered to the delivery address indicated by the Customer at the time of placing his/her order, provided that such delivery address is located in one of the countries where PVDB offers delivery of its Products (see Article 1).

To that end, the Customer undertakes to have communicated an exact delivery address to PVDB.

Delivery costs are borne entirely by the Customer and will be calculated and displayed during the checkout process before the Customer finalises the order. The delivery costs vary depending on the delivery address, the shipping method selected and the weight and size of the Products ordered.

PVDB primarily uses bpost (Belgium), PostNL (Netherlands) and other postal and courier services for deliveries. The Customer may select from the available shipping options presented at checkout, which may include standard delivery, tracked delivery, or express delivery, subject to availability for the delivery destination.

The delivery times stated on the Website and found in the shipping information must be regarded as a commitment of means and cannot be invoked against PVDB. Standard delivery typically takes between 4–10 business days from the confirmation of the order, depending on the destination country. Specific delivery timeframes for each shipping method will be displayed at checkout.

The Customer is responsible for providing accurate and complete delivery information. PVDB cannot be held liable for delays or non-delivery resulting from incorrect or incomplete address details provided by the Customer.

Once the Products have been dispatched, the Customer will receive a shipping confirmation e-mail containing tracking information (where available) to monitor the delivery progress.

Should the Customer, in any way, organise a delivery outside of the designated territory, on their own initiative, they do so entirely at their own risk and expense, and PVDB can therefore in no way be held responsible for the delivery, return process or refund thereof, nor can it guarantee any customer service.

PVDB reserves the right to split orders into one or more deliveries as Products are available. Each delivery will be notified by e-mail. Deliveries will be accompanied by a delivery note which also gives details of the Products delivered. The Customer will not bear any additional shipping costs if PVDB decides to split an order into several deliveries.

Should a delivery go missing during the delivery process, and the provisions of this article are complied with, PVDB will send a new shipment entirely at its expense if the Product is still available, or refund the value of the order including transport costs.

The risks of loss and/or damage pass to the Customer on delivery to the delivery address mentioned during the ordering process or any other delivery preferences specified by the Customer.

ARTICLE 8 - RIGHT OF REVOCATION

The Customer has fourteen (14) days from the day of receipt of the Products ordered to exercise its right of revocation, without the need to provide any reason.

The Customer will inform PVDB of its decision to revoke by sending a clear, unambiguous declaration by e-mail to: info@paulienvandenbrande.com or by post to: Customer Service, at Nieuwe Sint-Annadreef 50, 8200 Brugge, Belgium. This notification can either be made through the return section within our Website or by submitting any other explicit statement of the Customer's decision to exercise the right of revocation. The Customer can use the model revocation form attached in the Annex to these Terms, but this is, however, not mandatory.

The Customer shall return the Products to PVDB immediately and in any case, at the latest fourteen (14) days after having communicated the decision to revoke.

The return of the Products must be made by the Customer:

  • within fourteen (14) days as from the time the Customer has notified PVDB of the intention to exercise the right of revocation;

  • in their original packaging, in perfect condition, unused, and accompanied by all the accessories and documents provided with them at the time of delivery (notice, warranty, tags, etc.) and the delivery slip enclosed with the Products delivered.

The Customer will return the item by filling in the return document included with the Products and sending the Products back to the address indicated on the included return label. The Customer will keep proof of postage until the Products have reached PVDB.

The costs of returning the Products will be borne by the Customer, unless PVDB provides a pre-paid return label for certain countries, in which case the return will be free of charge. In both cases, the Customer shall use the provided return label, so that the tracking of the parcel can be ensured. If the provided label is not used, the Customer will bear the responsibility for the Products (including any damage or loss) until they reach PVDB.

In case the aforementioned conditions are fulfilled and PVDB has received the Products, PVDB will refund the Customer the full sum of the order, including the purchase price and transportation costs (other than additional charges arising from the Customer's choice of a different method of delivery than the least expensive type of standard delivery offered by PVDB). In case of a partial return, the initial transportation costs will not be refunded to the Customer.

The full purchase price (including the standard transportation costs) will be refunded within 14 calendar days of PVDB receiving the returned Products in good time, provided all conditions as specified above have been strictly complied with. Reimbursement will be made by crediting the Customer's bank account. If earlier, the 14-day period runs from the day on which the Customer supplies evidence of having sent the Products back.Under no circumstances can the amount repaid ever exceed what the Customer actually paid.

For this refund PVDB will use the same means of payment as the Customer used for the original transaction unless expressly agreed otherwise, and in no event will the Customer be charged for this refund, less any gift cards or discounts used to pay for the order. The Customer will be refunded in accordance with the procedures agreed with the bank which issued the card.

The Customer shall be liable for any loss in value of the Products if such loss in value is due to having used the Products to an extent more than necessary to establish the nature, characteristics, and the functioning of the Products.

Please note that the right of revocation may only be exercised from the reception of the Product(s). Thus, it cannot be exercised during the time between the order confirmation and the reception of the Product(s).

Any personalised, revised or altered Products, or any Product returned in a damaged, used beyond what is necessary to establish the nature, characteristics and functioning of the Product, incomplete or soiled condition, may not be refunded or exchanged.

It is not possible to exchange Products. If the Customer wishes to have another Product instead of the initial order, the Customer can invoke the return right as described above and subsequently place a new order for the desired Product.

ARTICLE 9 - GIFT CARDS

Gift cards are sold online on the Sites.

Gift cards by e-mail are only sold on the Sites and delivered in an electronic form, to the specified e-mail address. The Customer can also buy a physical gift card that will be sent by post to the designated address.

The following additional terms and conditions apply to gift cards:

Gift cards can be redeemed in the online stores;

Gift cards remain valid for 3 years;

Gift cards can be redeemed in part or in their entirety;

The Customer can freely determine the value of the gift card they will be buying, as long as the amount is between €20 and €5,000.

Without prejudice to the Customer's right of revocation mentioned under Article 8, gift cards as well as any Product purchased through a gift card may not be exchanged for cash or any other payment, not even partially.

The code on the gift card can be used in the online order process on the Sites. After reviewing and confirming the order, the Customer shall enter the code stated on the gift card. Depending on when the gift card was issued, the date of issue (DDMMYY) or the pin code, stated on the gift card or in the gift card e-mail, should be filled in during the check-out process. Value amounts used for purchases are deducted from the gift card balance.

If the total order is less than the value of the gift card, the outstanding amount will remain available on the gift card.

If the total order exceeds the value of the gift card, the remaining balance must be paid through one of the available payment methods on the Sites.

Gift cards by e-mail will be e-mailed to the recipient after processing the order once the payment has been confirmed. PVDB is not liable for the delivery of a gift card by e-mail to a non-existent or wrong e-mail address. It is the sole responsibility of the Customer that the input of information (such as the e-mail address of the recipient) is correct and double-checked.

PVDB is not responsible if a gift card is stolen, resold, destroyed, lost or used without the Customer's permission.

ARTICLE 10 – Warranty

In case of faulty or non-conforming goods, the Customer can contact Customer Service via the contact form which can be found under the 'Contact' option, or via the e-mail address info@paulienvandenbrande.com.

The Customer shall be entitled to the two-year legal guarantee of conformity for goods, as described below.

Conformity

The seller shall deliver a product compliant with the contract and is responsible for any lack of conformity which exists at the time of delivery. The seller is also responsible for conformity defects resulting from the packaging, instructions for assembly or installation when these have been made its responsibility by the contract or have been produced under its responsibility.

The Customer has the right to reject the Product because of its lack of conformity within 24 months from the delivery of the goods. Any non-conformities which appear within 24 months from the delivery of the Products are deemed to exist at the time of delivery, unless the contrary is proved.

From the moment PVDB receives the defective Product, PVDB will at the Customer's choice either repair the defect or replace the Product with a Product free of defects (so-called supplementary performance). Before asserting other warranty claims, PVDB shall be given a reasonable opportunity and time to perform such supplementary performance. PVDB can refuse the type of supplementary performance chosen by the Customer if it is only possible with disproportionate costs. The conformity warranty shall not imply any costs for the Customer.

If the supplementary performance fails, the Customer can obtain a reduction of the price according to statutory provisions or a termination of the contract at his/her choice.

The right to terminate is excluded if the delivered Products deviate only insignificantly from the agreed quality or if the contractual or normal use of the Products is only insignificantly impaired.

Hidden Defects

A seller is bound to a warranty for any hidden defects of the product sold which make the product unfit for the use for which it was intended, or which impair the use of it so that the purchaser would not have purchased it, or would only have offered a lower price for it, if the purchaser had known them.

The Customer has the right to reject the Product because of its redhibitory defects within a period of two years following the discovery of the defect.

In case of hidden defects, the Customer may choose between returning the product to PVDB and being reimbursed the price of the Product, or keeping the Product and obtaining a reduction in price.

Procedure for Non-Conforming Products

If the Products delivered are not the Products that were ordered, the Customer shall:

  • inform PVDB as soon as possible, by means of an e-mail sent to info@paulienvandenbrande.com, explaining why the Product is not in conformity with his/her order;

  • return the concerned Product(s) in their original packaging, in perfect condition, unused, and accompanied by all the accessories and documents provided with them (notice, warranty, certificate of authenticity, etc.) and a copy of the delivery slip enclosed with the delivered Product(s);

  • follow the steps of the return procedure suggested by PVDB, as described on the Website and/or in the return information notice that came with the order, in the context of which all the costs of returning the Product(s) will be borne by PVDB;

  • the costs of returning the Product(s) will however be borne by PVDB only if the Customer is right in claiming that the Product returned is not compliant with his/her order, and subject to providing evidence of said costs to PVDB. They will then be reimbursed by crediting the Customer's bank account accordingly;

  • if it is not possible to exchange or repair the returned Product, reimbursement of the price invoiced for non-compliant Products that have been returned will be effected by crediting the Customer's bank account within, at the latest, fourteen (14) days as from PVDB's receipt of the returned Products.

Customers must contact Customer Service should they wish to invoke this guarantee immediately and notify PVDB of the non-compliance via Customer Service in writing in any case within two months of discovering the defect.

Under no circumstances does the guarantee apply to Products which are damaged intentionally or by the Customer's negligence, nor does it apply if the damage is due to sleet, transport or incorrect use.

Customers can contact Customer Service if they have any queries regarding the above.

ARTICLE 11 - SALES FOR PRIVATE PURPOSES

Providing the guarantee under Article 10 and customer support is important to PVDB.

Therefore, all acts that may negatively affect Customer service are forbidden, including relabelling the Products or exporting them outside the European Union for commercial purposes.

The sale of Products is for private purposes only, and exclusively reserved to private individuals.

In no case may the Sites be used by professional Customers, whether operating alone or in a group, regardless of the method of the marketing of the Products (including online marketplaces, shopping galleries, broker services, or brick-and-mortar stores). The Products are offered for sale only for the purchase of usual amounts placed by average customers.

PVDB reserves the right to suspend or even refuse to fulfil an order with a Customer if there is a prima facie indication that the order is placed by a professional Customer. The costs incurred by PVDB for the verification of compliance of the prohibition of export for commercial purposes outside of the European Union will be borne by the Customer in case of infringement.

ARTICLE 12 - REPEATED RETURNS

PVDB offers a flexible return policy to facilitate the Customer's shopping experience on paulienvandenbrande.com.

PVDB also monitors the number of returns made by its Customers to ensure an optimal service.

In the event of repeated returns, PVDB reserves the right to decline future online orders.

ARTICLE 13 - INTELLECTUAL PROPERTY RIGHTS

For the purpose of this provision, "Intellectual Property Rights" means the Brand, and all rights in and to copyrights, trademarks, design, know-how and registered domain names, including but not limited to the domain names "paulienvandenbrande" or any translation and/or representation thereof or any related words, as well as all texts, databases containing data published on the Sites, the layout, look and feel, and graphic design of the Sites, the sales catalogue, photos, images, videos and music on the Sites which are subject to protection under copyrights, database rights, trademark rights, patent rights or any other form of intellectual property right.

The Customer is aware of the existence of these Intellectual Property Rights and commits to respect at all times such Intellectual Property Rights.

PVDB is and remains at all times the exclusive owner of such Intellectual Property Rights.

The Customer can therefore not copy, publish, imitate, exploit or use PVDB's Intellectual Property Rights in any other way in any form whatsoever without PVDB's prior written consent. Such consent must be obtained in writing, unless PVDB has granted a right to share certain aspects of the Intellectual Property Rights via social networks. In such case the grant of rights is limited to the specific elements of the Intellectual Property Rights identified by PVDB, to ways of use and social networks for which PVDB has made it possible to share them; in any case such grant of right is non-exclusive only.

The Customer undertakes not to download, disseminate, reproduce or modify the Website, either in whole or in part, in any form whatsoever.

ARTICLE 14 - LIABILITY

Subject to the limitations specified in applicable mandatory legislation, PVDB may only be held liable for direct damages resulting from its fault, negligence or fraud under these Terms of Use.

To the extent legally permitted, PVDB cannot under any circumstances be held liable for any losses suffered directly or indirectly (loss of use, loss of profits, loss of opportunity, etc.) arising out of using the Sites or of their being unavailable. It cannot be held liable for any damage to the Customer's systems incurred through visiting the Sites, including being hacked or computer viruses.

The Products are designed for personal and domestic use, to the exclusion of resale purposes. PVDB may not be held responsible for any loss of profits or business in relation with any resale activity carried out by the Customer.

PVDB cannot be held liable for not delivering orders because products are out of stock or for reasons beyond its control, including circumstances of force majeure, including disturbances of or suspension of transport, post or communications services, in the event of flood or fire, accidents or damage inherent in using the network.

The Company's performance of all or part of its obligations will be suspended, as of right, without liability, in the event of the occurrence of a force majeure event. PVDB will inform the Customer of any such event within at the latest eight (8) days of its occurrence. If this suspension of PVDB's performance of its obligations continues for more than thirty (30) days, the Customer will have the possibility of cancelling the order in progress. In this case, the Customer will be reimbursed by PVDB as soon as possible by crediting his/her bank account.

ARTICLE 15 - GOVERNING LAW AND JURISDICTION

These Terms of Use are governed by Belgian law, without prejudice however to any applicable local public order regulations benefitting consumers in accordance with EU Regulation 593/2008 ("Rome I") of 17 June 2008.

Should any disputes arise between the Parties concerning the purchase of Products under these Terms of Use, the courts of the judicial district of [INSERT PVDB'S REGISTERED DISTRICT], Belgium will have exclusive jurisdiction to hear the case, without prejudice to any rights the Consumer may have under Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters ("Brussels I bis") of 12 December 2012.

In case of any dispute between PVDB and a Customer located in the EEA that has not been resolved amicably by PVDB's customer services within a reasonable period of time, the Consumer may appeal to the Consumer Mediation Service by clicking on this link: https://consumentenombudsdienst.be/en.

Customers based in the EU, Norway, Iceland or Liechtenstein may also file a complaint on the following website, in order to seek online dispute resolution: http://ec.europa.eu/consumers/odr/. The European Commission will transfer complaints to the relevant national ombudsmen.

ARTICLE 16 - CONTACT AND COMPLAINTS

Should they have any queries or complaints concerning their purchases, Customers can contact PVDB by filling out the contact form available in the 'Contact' section of the Sites. Alternatively, the Customer can reach Customer Service directly at info@paulienvandenbrande.com. PVDB will endeavour to handle complaints within ten (10) business days. PVDB will review queries on working days from 9 a.m. to 5 p.m. and will make every effort to answer all questions within 24 hours.

ARTICLE 17 -  PERSONAL DATA

PVDB collects the following personal data: the identity, e-mail address, telephone number, the address of the Customer's usual place of residence, the delivery address, and the means of payment.

This data is strictly necessary in order to process the order and may only be communicated to PVDB's contractual partners intervening in the performance of the order (e.g. banking institutions for the payment of orders or shipment companies ensuring delivery of the Products).

The Customer has the right to access, require deletion or modification of his/her personal data. In order to exercise this right, he/she may send a request to: info@paulienvandenbrande.com. However, the Customer is informed that without such data, PVDB may not be able to perform his/her order(s).

ARTICLE 18 - MISCELLANEOUS

PVDB may vary the present Terms of Use at any time, including to comply with its statutory obligations. Changes notified via the Website will apply to all subsequent offers and orders. The Terms of Use applicable to an order placed by a Customer are those in force on the date on which the order is placed.

PVDB reserves the right to vary the design and content of its website at any time.

If Customers wish to have their account deleted, they can request this by contacting Customer Service at info@paulienvandenbrande.com, in accordance with the Privacy Policy.

If one or more article(s) or paragraph(s) of the present Terms of Use are or become invalid or unenforceable in whole or in part, this shall not affect the validity and enforceability of the remaining provisions.

ANNEX 2 – ADDITIONAL PROVISIONS FOR SPECIFIC COUNTRIES

European Union

If you are a resident of an EU country, then you hereby agree that notwithstanding anything in these Terms of Use to the contrary and where permitted under applicable law, you may exercise your right of withdrawal until 14 days from the receipt of the Products.

Switzerland

If you are a resident of Switzerland, then you hereby agree that notwithstanding anything in these Terms of Use to the contrary and where permitted under applicable law, you may exercise your right of withdrawal until 14 days from the receipt of the Products. Swiss consumer protection law shall apply to the extent it provides greater protection than these Terms of Use.
